ERISA Lawyer

Skillfully Handling ERISA Litigation in Massachusetts State and Federal Courts

ERISA LitigationFor more than 17 years, ERISA lawyer Jonathan M. Feigenbaum, Esquire, has successfully handled many long-term disability insurance cases under both the Employee Retirement Income Security Act (ERISA) and state laws. Mr. Feigenbaum is able to litigate your disability claim in either state or federal courts across the county, which is especially important since ERISA litigation is almost always decided in the federal courts.

Long-Term Disability Litigation: ERISA and Non-ERISA Claims

ERISA litigation is very different from litigation of non-ERISA, individual disability insurance claims. Litigation of an ERISA disability insurance claim usually does not involve live testimony by witnesses, and there are no jury trials. The litigation process is best described as an argument based on a review of the insurance company file. A judge’s decision is often based solely on the information that is contained in the insurance company’s claim file. It is important to know that if a piece of evidence is not in the claim file, such as an updated doctor’s report, it will not be seen by the judge. For this reason, you must be sure to submit detailed application forms, doctor’s reports, and other documentary evidence either with your initial application or in the appeals process.

Litigation Related to Other Aspects of ERISA Benefits

We also represent employees in litigation of claims for other benefits governed by ERISA. As well as governing disability insurance, ERISA regulates health insurance benefits, life insurance, pensions, and severance benefits, and virtually all other employee benefits when provided by a private sector employer. If you are having trouble getting your insurance company or employer to pay for healthcare benefits, we can help you take your claim to court. If your employer withheld or did not pay the proper amounts of your health care benefits or pension, we may be able to help you remedy your situation.
